Kayanja Case: Magistrate accuses defence lawyer of delay tactics

Magistrate Adams Byarugaba has issued an ultimatum to the defence, in the Pastor Kayanja case after being frustrated by repeated delays. The defence lawyer, Robert Ojambo, has often been absent, citing reasons like illness.

The case, involving charges of conspiracy to obstruct justice, conspiracy to commit a felony, criminal trespass, and giving false information, has been adjourned over five times due to such tactics.

The accused—Reagan Ssentongo, Peter Serugo, Khalifa Labeeb, Israel Wasswa, Jamil Mwandha, Alex Wakamala, Aggrey Kinene, Martins Kagolo, and Moses Tumwine (who remains at large)—have opted for unsworn testimony, avoiding cross-examination by Chief State Attorney Jonathan Muwaganya.

On July 7, 2025, Aggrey Kinene, linked to Pastor Jackson Ssenyonga, testified, claiming no acquaintance with the co-accused. However, prosecution evidence, including a phone matrix from Police Officer Bill Ndyamuhaki, showed frequent communication between Kinene and Ssentongo, contradicting his claim.

Pastor Ssenyonga’s involvement in hiring defense lawyers was noted. Dr. Sam Kalungi’s testimony, stating no medical evidence of sodomy, weakens the accused’s initial claims against Kayanja.

Byarugaba’s decision to proceed without lawyers if delays persist reflects his intent to expedite the trial, which he noted does not involve a capital offense.

The court banned visual media coverage after distorted videos surfaced online, though the prosecution has petitioned the High Court to allow such coverage. The case is set to resume on July 18, 2025.
